Terms of Use
Last updated 2026-07-17
By visiting the usekayu.com website, or by installing and using the Kayu app, you agree to these Terms of Use. If you do not agree, do not use the site or the app.
1. Who we are
The usekayu.com website and the Kayu app are operated by Lucas Tostee, sole proprietor (auto-entrepreneur / micro-entreprise regime), 66 rue des Remparts, 33000 Bordeaux, France (SIRET 830 928 412 00014). Contact: app.kayu@gmail.com. Where these Terms refer to "we", "us", or "Kayu", they mean Lucas Tostee acting as the operator of the site and the app.
2. What Kayu is
Kayu is a service consisting of a marketing site (usekayu.com) and a mobile app that aggregates medication information from public government sources, currently France (Agence nationale de sécurité du médicament et des produits de santé — ANSM) and Canada (Health Canada). The app lets you look up a drug, view its public details, save pins for later, and (optionally) sign in to associate your usage with an account.
Sign-in is optional: most of the app works anonymously.
3. Kayu is not medical advice
This is the most important clause in this document. Read it carefully.
The medication information shown in Kayu is sourced from third-party government databases and aggregated for your convenience. It is not medical advice. Kayu is an information tool: it provides no diagnosis, treatment, prescription, dosage guidance, or any other form of medical recommendation, and it is not a medical device. Kayu is not a substitute for consultation with a qualified healthcare professional — a doctor, pharmacist, nurse, or other licensed provider.
Before making any decision about your health, the health of someone you care for, or the use of any medication, consult a qualified healthcare professional. Do not start, stop, change, or substitute any medication based solely on information shown in Kayu.
We make a reasonable effort to keep the data current and accurate, but we do not guarantee that the information shown is complete, current, accurate, error-free, or applicable to your situation. Government data sources update on their own schedules; transcription, translation, mapping, and aggregation errors can occur. We disclaim, to the maximum extent permitted by applicable law, any liability for harm arising from reliance on Kayu's information without independent professional verification.
In an emergency, call your local emergency number (15 or 112 in France, 911 in Canada). Do not use Kayu in an emergency.
4. Licence to use the service
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to access the site and use the app on devices you own or control, solely for your own personal, non-commercial use.
This licence does not grant you any right to:
- copy, modify, distribute, sell, lease, sublicense, or otherwise transfer the site, the app, or any part of them;
- reverse engineer, decompile, or disassemble the app, except to the limited extent applicable law expressly permits notwithstanding this restriction;
- remove or alter any proprietary notices, marks, or branding;
- use the service or its data for commercial purposes, including resale, redistribution, or as input to a commercial product.
5. Your obligations
When using Kayu you agree:
- not to scrape, crawl, or systematically extract data from the site, the app, or its backend APIs by automated means;
- not to use bots, scripts, or any other automated tooling against the service;
- not to attempt to gain unauthorised access to any account, server, or system associated with Kayu;
- not to interfere with the normal operation of the service (overload, flooding, spam, etc.);
- not to submit content (feedback, requests) that is unlawful, infringing, abusive, hateful, defamatory, or that contains personal data about anyone other than you;
- to comply with all applicable laws and regulations in your jurisdiction.
We may suspend or terminate your access if you breach these obligations (see §11).
6. Intellectual property
The usekayu.com website and the Kayu app — including their source code, design, brand name, logo, user interface, and copy — are the property of Lucas Tostee. They are protected by intellectual property law in France and internationally.
The medication data shown is not our property. It is published by government data sources (in France, the ANSM open-data programme; in Canada, the Health Canada Drug Product Database and related programmes) and used under those sources' open-data licences. Source licence terms govern the medication data itself.
7. Third-party services
Kayu relies on:
- Vercel Inc. (USA) for hosting the
usekayu.commarketing site; - AWS (Amazon Web Services EMEA SARL, Luxembourg) for the app's backend hosting, in EU region eu-west-3 (Paris, France);
- Apple Inc. for the App Store distribution channel and, optionally, for Sign in with Apple authentication;
- Government data sources (ANSM in France, Health Canada in Canada) for the medication content itself.
Each of these third parties has its own terms and policies. Kayu is not responsible for their service quality, availability, or terms.
8. Disclaimers
To the maximum extent permitted by applicable law, the site and the app are provided "as is" and "as available", without warranty of any kind, whether express, implied, statutory, or otherwise. We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted operation.
We do not warrant that the service will be free from errors, defects, viruses, or interruptions, or that data will be preserved without loss.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including, in the European Union, liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, and for gross negligence. Nothing in these Terms restricts your rights as a consumer under mandatory consumer-protection law in your jurisdiction.
9. Limitation of liability
To the maximum extent permitted by applicable law, our total cumulative liability to you for any claim arising out of or relating to the service or these Terms is limited to the amount you have paid us for the service in the twelve (12) months before the event giving rise to the claim. The service is currently free, so this amount is €0.
We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, or business interruption — even if we have been advised of the possibility of such damages.
This clause does not affect your statutory rights as a consumer, and does not limit liability that cannot be limited under applicable law (see §8).
10. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless Lucas Tostee against claims, damages, and reasonable expenses arising from your breach of these Terms or your unlawful use of the service. This clause does not apply to consumers to the extent applicable consumer-protection law forbids it.
11. Termination
You may stop using the service at any time, with no notice required. You may delete your account from Settings → Account → Delete account (see §E of our Privacy Policy).
We may suspend or terminate your access, in whole or in part, if you breach these Terms — in particular §3 (medical disclaimer reliance), §5 (user obligations), or §6 (intellectual property). Where reasonably possible and except for serious or repeated breaches, we will give you notice before termination and an opportunity to remedy.
Termination does not affect rights or obligations that, by their nature, survive — including §3 (no medical advice), §6 (intellectual property), §8 (disclaimers), §9 (limitation of liability), and §12–§13 (governing law and jurisdiction).
12. Governing law and jurisdiction
For users resident in France and elsewhere in the European Union: these Terms are governed by French law. Disputes shall be brought before the competent French courts, subject to any mandatory provision of EU consumer-protection law (notably Regulation (EU) No 1215/2012, "Brussels I bis") that lets a consumer sue in their country of residence and be sued only there.
For users resident in Canada outside Quebec: these Terms are governed by French law, subject to the mandatory consumer-protection law of your home province where it provides protection that cannot be waived by contract.
For users resident in Quebec: these Terms are governed by French law, but article 3149 of the Civil Code of Quebec applies in your favour. Article 3149 provides that a Quebec consumer may bring action before a Quebec court regardless of any choice-of-law or jurisdiction clause to the contrary, and that Quebec consumer-protection law applies where it provides protection that cannot be waived. Nothing in these Terms reduces those rights.
Before any judicial action, the French Médiateur de la consommation may be contacted by users in France. We will publish the mediator's details once a dispute that might require mediation arises.
13. Changes to these Terms
We may update these Terms as Kayu evolves. The "Last updated" date at the top reflects the most recent change. Previous versions remain available in our public Git history. By continuing to use the service after a change becomes effective, you accept the updated Terms.
